Mediating a dispute

The 'Mediating a Dispute' round table will cover from both a franchisee and a franchisor perspective practical steps that each can take in order to enhance the prospects of resolving a dispute through mediation. The round table will cover:
  1. How to set up a mediation including the new requirements under the revised Franchising Code of Conduct and the consequences of non-compliance;
  2. What to do to prepare for a mediation including the persons to attend, the material to bring, the information to provide to the mediator and questions to ask in any pre-mediation conference with the mediator;
  3. How to mediate including different styles of mediation, offers and option generation, reality testing, requests of the mediator and legal representation;
  4. Steps after mediation including implementing the agreed resolution, continuing negotiations post mediation and other options.

The session will be hosted by Alicia Hill, Principal, McInnes Wilson Lawyers

Alicia is a Queensland Law Society Accredited Specialist in Commercial Litigation, a National Accredited Mediator on the Office of Franchising Mediation Panel of mediators and a graded Arbitrator through the Institute of Arbitrators and Mediators Australia. She practices as a Principal of McInnes Wilson Lawyers in commercial and regulatory matters including in Franchising and is a member of the FCA Legal Committee.
