Social Media Understanding and mitigating the legal risks

These days any smart franchisor knows that you have to be ‘online’ and actively participating in Social Media if you wish to maximise your reach to customers or clients. Not only is it necessary to keep up with a form of communication that has changed the way the world interacts, but Social Media is in fact an essential marketing tool that, when used correctly, has proven its potential to increase customer bases, customer engagement and business growth. With all of its glory and positive press however, the use of Social Media in business also comes with its downfalls and there are a number of associated risks and legal implications for you to be aware of. In this presentation Peter McLaughlin looks at some of the major issues franchise owners could face in regards to Social Media, including reputational damage and defamation, their legal implications and how to alleviate these risks.

Peter is a partner of redchip lawyers and heads the Franchising, Licensing and Distribution area of practice. He has been practising since 1988 with a particular interest in franchising for over 15 years, and now practices primarily in franchising and commercial law. Peter has been a member of the Queensland Law Society Franchising Law and Practice committee since 1998 and regularly advises franchisees and franchisors on a range of matters including, franchise systems, the Franchising Code of Conduct, buying and selling of franchises and general intellectual property and commercial issues.
