Can Franchisors Control Pricing?
Consumer Law Update

Competition law compliance is critical for all franchisors.  In franchise systems we often focus on everyone as part of the one team working together to build a brand.  Under Australia's cartel laws, however, franchisors and franchisees are often treated as competitors.  This means that controls on pricing and products within franchise systems, if not structured correctly, can breach cartel laws – exposing franchisors and franchisees to very substantial penalties. 

Franchisors must be aware of the Dos and Don'ts applicable to each of their businesses.  This roundtable provides franchisors with an opportunity to ensure that they are fully compliant by focussing on specific examples.  Attendees will have a clear understanding of the competition law pricing issues that affect each of their franchise businesses.  Attendees will have an opportunity to discuss specific issues and the key outcomes of the roundtable will be:

  1. No price fixing by franchisors;
  2. No retail price maintenance by franchisors;
  3. Franchisors understanding who their competitors are; and
  4. Correct clauses in franchise agreements.
