Social media – understanding and mitigating the legal risks

Social media is rapidly transforming the way businesses communicate with customers and potential customers. By harnessing the opportunities social media provides, businesses are able to communicate instantly with anyone in the world with access to the internet, actively engage them in two-way dialogue and obtain valuable insights into their own products and services. However, communicating with customers via social media differs markedly from traditional media and online publications, and poses distinct and myriad legal issues and risks.

By looking at recent examples and case studies, attendees will gain an understanding of these legal issues and the strategies that can be employed to mitigate and manage the risks effectively. The presentation will be interactive and provide attendees an opportunity to raise questions and discuss issues specific to their business.

This roundtable will look at

1. What is different about social media?

  • Overview of the main social media types and examples of each – Facebook, Twitter, Vimeo, YouTube, LinkedIn, Digg
  • What opportunities does Social Media create - what can it be used for and how is it used in commerce?
  • Why is social media different to traditional forms of communications?

2. Overview of the legal risks relevant to social media. What are the laws and how do they apply?

  • Defamation
  • Privacy
  • Australian consumer law and advertising guidelines
  • Spam Act
  • Intellectual Property
  • Trade promotion regulations

3. Case studies

  • How can social media be used effectively?
  • How can it go wrong?
  • Media reporting of social media and brand management

4. What can be done to mitigate legal risks?

  • Terms and conditions for users - what they should contain?
  • Social media policy – how should social media sites be administered and overseen
  • Complying with the terms and conditions of each social media platform
