WA Roundtable 01/02/12

Maintenance and Make-Good Obligations
Under Leases

All buildings are going to require maintenance at some point - but it's not always clear who is ultimately responsible for undertaking the repairs, especially where more extensive work is required.

Getting the job done quickly is paramount as this can impact on the franchisee's trade, not to mention safety. At the end of the lease, what are the franchisee's make-good obligations? This can be especially relevant where the franchisee has made the premises better than they were!

Come and discuss some of the common problems, and how the franchise owner can ensure that clear wording is used to avoid future arguments with its landlord.

This roundtable event will discuss:

  • common repair obligations
  • the difference between repairs and 'structural' repairs
  • what 'fair wear and tear' means
  • some common misconceptions surrounding make-good obligations

Facilitated by Joe Lazzara, Principal, Borrello Legal

This roundtable will be held at Borrello Legal,
Unit 1/9 Mercer Lane, Joondalup WA

Venue: Western Australia
Phone Enquiries: 1300 669 030
