2013 Franchising Code of Conduct review FCA submission

The 2013 Franchising Code of Conduct Review was announced by the Minister for Small Business on 4 January, 2013. This scheduled review will analyse the effectiveness of the 2010 amendments to the Franchising Code of Conduct, along with further questions outlined in the documents below.

The FCA is a strong supporter of the current regulatory framework, which is clearly best practice when compared to other regulatory regimes around the world. The regulatory framework includes the Franchising Code of Conduct, but also includes the prohibitions on misleading or deceptive conduct and unconscionable conduct contained in the Competition and Consumer Act, which have wide potential application to franchising.

The FCA welcomes the appointment of Mr Alan Wein to the review. Although this is a scheduled review, it should be considered in the context of the many previous reviews of the franchise sector. The collective input and wisdom of those involved in previous reviews and inquiries have created our current regulatory environment, which the FCA believes fairly balances the interests of franchisors and franchisees in this dynamic industry sector where almost all participants are small businesses.

The new version of the Franchising Code of Conduct came in to effect on 1 January, 2015.
